Terms of Use

End User License Agreement (version 1)

Effective [EFFECTIVE DATE]

These terms are an agreement between you and [COMPANY LEGAL NAME] ("we", "us"), the maker of Mosaic. They cover the Mosaic app and the services behind it. By creating an account or using Mosaic, you agree to them. If you don't agree, don't use Mosaic.

Our Privacy Policy explains what information we collect and how we use it. Face recognition (section 7) has its own terms, which you agree to only if you turn it on.

1. WHO CAN USE MOSAIC

You must be at least 13 years old, or 14 if you live in Quebec. If you are under the age of majority where you live, you need a parent or guardian's permission, and they agree to these terms for you.

You can't use Mosaic if we have banned you before, or if the law where you live prohibits it.

2. YOUR ACCOUNT

You sign up with Sign in with Apple or an email address and password. Keep your sign-in details safe: you are responsible for what happens on your account. Tell us at [SUPPORT EMAIL] if you think someone else has used it.

Your account has a username, a display name and an optional profile photo. Every Mosaic user can see these, and can find you by your username.

3. HOW MOSAIC WORKS

Mosaic builds albums from your photo library. To do that, the app analyses the photos it can access on your iPhone: what's in them, when and where they were taken, and how good they are. You choose how much of your library Mosaic can see in iOS Settings.

Faces in your photos. As part of this analysis, the app finds the faces in your photos and describes each one as a set of numbers, so it can tell faces apart and later match them. This happens only on your iPhone. These descriptions aren't linked to any name or account, and are never uploaded to Mosaic or shared with anyone. They are kept on your iPhone until you sign out or delete the app, and are removed sooner when you delete the photo (if Mosaic has access to your full library). They are only used to recognise people if you turn on face recognition (section 7), and then only people who have chosen to share their face with you.

By accepting these terms and giving Mosaic access to your photos, you consent to this on-device analysis, including of the faces in your photos. Removing Mosaic's photo access in iOS Settings stops it; signing out deletes its results.

Photos are added to albums in one of three ways, chosen in Settings:

  • Full Curation (the default): you review and approve every photo before it is uploaded.
  • Smart Curation: you review photos when you create or join an album; after that, new photos that match the album's rules are added automatically.
  • Full Background: photos that match an album's rules are added automatically, including in the background.

You can also add photos by hand or take them in the app. With automatic modes, photos are added without you seeing each one first, so choose the mode that suits you. You can remove photos you added at any time.

4. YOUR PHOTOS AND CONTENT

You own the photos, comments, drawings and other content you add to Mosaic ("your content"). We don't claim ownership of it.

So that we can run Mosaic, you give us a worldwide, non-exclusive, royalty-free license to store, copy, process, resize, convert and display your content, and to show it to the people you share it with. We use this license only to provide Mosaic to you and the people you share with. It ends when your content is deleted, except for copies others have saved and copies kept as described in section 12.

You promise that you have the rights to the content you add, and that adding it doesn't break the law or anyone's rights, including the privacy of people who appear in your photos.

5. ALBUMS AND SHARING

When you add a photo to an album, every member of that album can see it, including people who join later. They can also see:

  • the photo file as you uploaded it, including the information stored in it, such as camera details and the place it was taken;
  • where it was taken: its GPS location and the address it corresponds to, down to the street;
  • when it was taken and who added it;
  • where faces, people and animals are in the photo, and which Mosaic users were recognised in it (section 7);
  • comments, reactions and drawings on it.

Album members can save, screenshot and share what they see. We can't control or recall copies they make, so only add photos you are comfortable sharing with everyone in the album.

Album owners control the album: its name, rules and members, and can remove any photo or person. Each member has a role (owner, contributor or viewer). Whoever holds an invite link can see a preview of the album and its members, and join it; each link works once.

Leaving an album removes the photos you added to it. Deleting a photo you added removes it from the album.

6. YOUR PRIVACY

Our Privacy Policy, in the app and at [PRIVACY POLICY URL], explains what we collect, why, who we share it with, how long we keep it and your rights. The most important points:

  • Photos you don't add to an album stay on your iPhone, but the locations stored in them are sent to our servers to look up place names.
  • Mosaic is hosted by Google Cloud and Firebase in the United States, so if you live in Canada your information is stored outside Canada.
  • We use service providers, including Google, for maps, AI features, analytics and notifications.
  • We don't sell your personal information.

You can see, correct and delete your information in the app, and contact our privacy officer at [PRIVACY EMAIL].

7. FACE RECOGNITION

Face recognition is optional and off until you turn it on. It lets you, and friends you choose, recognise each other in photos. Before you turn it on, we show you its separate terms and ask for your consent. They are published at [FACE RECOGNITION TERMS URL] and explain how your face data is made, protected, shared, kept and deleted. Mosaic works without it.

8. AI FEATURES

Mosaic uses AI to pick photos, suggest albums, name people and places, and help you set up albums through a chat assistant. AI can be wrong. Check its suggestions before you rely on them, and don't put anything in the assistant you wouldn't want processed by our service providers (see the Privacy Policy).

9. RULES FOR USING MOSAIC

We have zero tolerance for objectionable content and abusive users. You must not use Mosaic to:

  • share content that sexually exploits or endangers children, in any form;
  • share intimate or sexual images of anyone without their consent;
  • share content that is illegal, sexually explicit, violent, hateful, or promotes self-harm;
  • harass, bully, threaten or impersonate anyone;
  • share photos of people in ways that break the law or their privacy, for example where they had a reasonable expectation of privacy;
  • infringe anyone's copyright, trademark or other rights;
  • spam, scam or mislead people;
  • access accounts, data or systems you aren't allowed to, collect data about other users, or use bots or scrapers;
  • copy, modify, reverse engineer or resell the app, or get around its security or limits, except where the law allows it;
  • interfere with Mosaic or other people's use of it.

We report child sexual abuse material to the National Center for Missing & Exploited Children and the authorities.

10. REPORTING, BLOCKING AND ENFORCEMENT

You can report a profile, photo or comment, and block anyone. Blocking someone hides you from each other, ends your friendship and stops face recognition between you.

We review reports and act on them promptly. We may remove content, and suspend or close accounts, that break these terms or the law, or that put others at risk. Where it is reasonable, we tell you what we did and why. When you report something, we keep a copy of it, along with the report, as evidence, even after the content or either account is deleted.

11. COPYRIGHT

If you believe content on Mosaic infringes your copyright, send a notice to our designated agent at [DMCA AGENT NAME, ADDRESS AND EMAIL], including: your contact details; the work you say is infringed; where the content is in Mosaic; a statement that you believe in good faith the use isn't authorised; a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorised to act for them; and your signature. We remove infringing content and close the accounts of repeat infringers.

12. DELETING YOUR ACCOUNT

You can delete your account in Settings at any time. Either way, it disappears for everyone straight away. You choose between:

  • Deleting with a 30-day grace period. Sign in within 30 days to restore it; after that it can't be restored.
  • Deleting now. It can't be restored from that moment.

Once your account can't be restored, we permanently erase its data. Erasure starts about an hour later, once every session on your devices has ended, and runs in the background until it's complete. It removes your profile, the photos you added (from every album, including albums other people own), your comments, reactions, drawings, friends, invites and settings. Albums you own are passed to another member.

Your face data doesn't wait: erasing it starts as soon as you delete your account, and normally finishes within minutes (section 7).

We keep, after deletion:

  • reports made by or about you, and the copies kept with them, for safety and legal reasons;
  • the record of when you agreed to and withdrew from face recognition, which holds no face data;
  • place names looked up from photo locations, which aren't linked to you and expire after 30 days;
  • anything we must keep by law.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering Mosaic. Unless it would be unsafe or unlawful, we'll tell you first and give you a chance to save your photos.

13. YOUR LICENSE TO USE THE APP

We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Mosaic app on Apple devices you own or control, as allowed by these terms and the App Store's Usage Rules. Mosaic, its design, software, models and brand belong to us or our licensors. These terms don't give you any rights to them beyond this license. If you send us feedback, we may use it without any obligation to you.

14. OTHER SERVICES

Mosaic uses services from other companies, which have their own terms. By using Mosaic's maps and place search, you also agree to the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps.html) and the Google Privacy Policy (https://policies.google.com/privacy). Sign in with Apple is covered by Apple's terms. We aren't responsible for other companies' services.

15. CHANGES

Mosaic will change over time. We may add, change or remove features, and may stop offering Mosaic. If we stop, we'll give you reasonable notice and a way to save your photos.

We may update these terms. If a change matters, we'll tell you in the app before it takes effect and ask you to agree again. If you don't agree, you can stop using Mosaic and delete your account.

16. DISCLAIMERS

We work hard to keep Mosaic running and your photos safe, but Mosaic is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We don't promise that Mosaic will always be available, error-free, or that AI features will be accurate. Keep your own copies of your photos: Mosaic is not a backup service.

Some places don't allow these exclusions, so some may not apply to you. Nothing in these terms limits rights you have under consumer protection law that can't be waived, including in Quebec.

17. LIMITATION OF LIABILITY

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Mosaic. Our total liability for all claims about Mosaic is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.

These limits don't apply to liability that can't be limited by law, such as for our gross negligence, wilful misconduct, fraud, or personal injury we cause, and don't apply in Quebec to the extent Quebec law forbids them.

18. RESPONSIBILITY FOR YOUR CONTENT

To the extent the law allows, you agree to cover our reasonable losses and costs from claims by others caused by your content or by your breaking these terms or the law. This doesn't apply to the extent the claim is caused by us.

19. LAW AND DISPUTES

Please contact us first at [SUPPORT EMAIL]: most problems can be solved quickly that way.

If you live in the United States, these terms are governed by the laws of [STATE], without regard to its conflict of laws rules, and disputes will be resolved in the state or federal courts of [COUNTY, STATE], unless the law where you live gives you the right to bring them elsewhere.

If you live in Canada, these terms are governed by the laws of your province or territory and the federal laws of Canada that apply there, and you may bring disputes in its courts.

20. APPLE

These terms are between you and us, not Apple. Apple isn't responsible for Mosaic or its content, or for maintenance or support. If Mosaic doesn't meet an applicable warranty, you can tell Apple and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation. Apple isn't responsible for any claims about Mosaic, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection, privacy or similar claims, or claims that it infringes someone's intellectual property; we are, as set out in these terms. You confirm that you aren't in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and aren't on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

21. GENERAL

These terms, the Privacy Policy and, if you turn it on, the face recognition terms are the whole agreement between you and us about Mosaic. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You can't transfer these terms; we can transfer them to a company that takes over Mosaic, and will tell you if we do. Sections 4, 11, 12 and 16 to 21 continue after your account is closed.
